Prosperity Energy Corp. v. Terfam Family, Ltd, 2015 Tex. App. LEXIS 6636 (Tex.App. 13th dist.) June 29, 2015

Mandatory venue case. Terfam et al. brought suit to recover amounts due under Lease Fund Agreements. Each sought to recover the sum of $157,500. No request was made to recover any interest in real property. However, the Agreements provided for Terfam et al to receive certain working interests in the leases acquired by the fund. Therefore, even though no interest in real property was sought by the petition, the court held that the agreements that Terfam et al sought to enforce did concern land and that venue was proper only in the county where the land was located.
